Do the Best Law Firms Advertise on Television?
It is impossible to turn on the television (or drive down the highway) without seeing a lawyer flexing his muscles, holding a big check, and promising Georgia brain injury, spine injury, truck accident, and wrongful death victims a huge payday. So, do the lawyers on TV and billboards really get the most money for a case?
While there are some very good lawyers who work for TV and billboard advertising firms, in general, lawyers that advertise on TV and billboards focus on settling cases as quickly and efficiently as possible. This is opposed to a firm, like ours, that specializes in working up and trying a case to a jury. In general, firms that try cases get better results for their clients. Again, there is no guarantee that this is the case and there are many good lawyers that practice law in different ways.
There a lot of reputable firms that advertise on the internet, through Google and Social Media marketing. The distinction is rather interesting. It likely has something to do with the history of attorney advertising in the United States.
For a long time, attorney advertising was illegal. This was the rule as recently as the 1970s. A U.S. Supreme Court decision changed this. In Bates v. State Bar of Arizona (1977), the Supreme Court held that lawyers had a First Amendment right to advertise their services. The advertising is protected as a form of commercial speech. Restrictions are permitted by State Bars, but no longer can an attorney be prohibited from advertising. Advertising for attorneys, then, is a relatively new thing.
